The following revised terms are effective (last revised) 25th February 2008 for MPAM members.
MgrCentral Pty Ltd reserves the right to modify these terms and conditions at any
time, and will provide notice of such changes via our blog at http://blog.mgrcentral.com.
ADVISORY
As in all matters related to your well being or your financial situation, you
should consult with your attorney or accountant before making any decision
which could adversely impact you.
MgrCentral Pty Ltd and members may
receive commissions from your purchases at our site, but no incentives or
discounts are offered to replace or offset these.
Nothing on our site should be construed by you as an invitation by us or
incentive from us to purchase any goods or services - any such purchase
made by you is entirely at your choice.
MPAM
Throughout our sites, the term "MPAM" refers to the membership program wholly owned and copyrighted to MgrCentral Pty.
Ltd.
CANCELLATION
You can cancel your membership at any time by clicking on the "Delete Account" link
in your member Lounge. It is your responsibility to cancel any subscription you
may have established to pay your membership dues. If you cancel your account
any commissions or moneys owed are also cancelled and are no longer due. No pro-rata
refund of fees paid in advance is available.
EXPIRY
If your account becomes unfinancial, either through cancelling a subscription or
failing to renew, any commissions or moneys owed are cancelled and are no longer due.
Your membership will be deleted and all access to facilities will be removed. Once an account is deleted it cannot be re-instated. If your account expires
any present or future moneys owed are also cancelled and no longer due.
AUSTRALIAN GOODS AND SERVICES TAX (GST)
If you are an Australian Resident the GST component is already included in any membership fees or other fees charged by us, as well as being included in the price of any goods or services, whether sold on our websites or on auction sites. All advertised prices are inclusive of GST (where applicable). MgrCentral Pty. Ltd. is a registered enterprise for the purposes of GST. This does not apply to members outside of Australia.
EMAIL COMPLIANCE WITH THE LAW
The following rules apply to MgrCentral Pty Ltd members with respect to (a) email
that contains MgrCentral Pty Ltd served and/or tracked link, (b) email that directs
recipient to an MgrCentral Pty Ltd served and/or tracked link, (c) email sent to
MgrCentral Pty Ltd and/or other members of the MgrCentral Pty Ltd network:
No Misleading Headers or Other Masking of Email Origin - An email
may not include falsification of header information, false registrations for email
accounts or IP addresses used in connection with email ads, and retransmissions
of an email ad for the purpose of concealing its origin. A subject heading of the
message likely would mislead a reasonable recipient as to the contents or subject
matter of the message.
Email Ads Must Contain Clear Identification - Messages containing
advertisements or solicitations must identify itself as such, and do so by "clear
and conspicuous" means. Further, the sender must identify itself as the initiator
and sender of the email including personal or company name, email and postal address.
As a member of the MgrCentral Pty Ltd network, members agree to comply with all
laws. Accordingly, MgrCentral Pty Ltd and its members are not procuring or inducing
any other member or third party to promote or allow the promotion of MgrCentral
Pty Ltd or one of its members in violation of the Act. Neither MgrCentral Pty
Ltd nor the person, whose goods or services are contained in a link served by MgrCentral
Pty Ltd, whether such link is in an email or the email recipient is directed to
such link, shall be considered to have initiated such an email or to have been the
sender of such an email.
Effective Method of Opt Out of Future Mailings - Senders of emails
covered by the Act must give recipients an effective means of requesting not to
receive future email ads from that sender. Effective means include:
(a) giving the recipient the ability to send a reply message or other "Internet-based
communication" (such as a link to a Web site where the recipient registers it opting)
enabling the recipient to opt out of future emails from the sender,
(b) keeping the opt out means used viable for at least 30 days after the original
message is sent, and
(c) ceasing transmission of email ads to that recipient no later than 10 business
days after receipt of an opt out request.
No Sale or Transfer of Opted out Email Addresses - Email senders,
or any other person who is aware of an opt out request, are generally prohibited
from selling or otherwise transferring email addresses of persons who have opted
out.
No Sexually Oriented Material in Email Messages - Emails that contain
sexually oriented material may not include a MgrCentral Pty Ltd served and/or tracked
link or direct the recipient to a MgrCentral Pty Ltd served and/or tracked link.
No Random Generation of Email Addresses - You are responsible for
knowing the source of your email list. No list and emailings may contain email addresses
obtained by the use of a program for random generation of email addresses, and/or
"scraping" web sites or online services ("harvesting addresses").
No Invalid Email Account Generation - Senders may not use scripts
or other automated means to register for multiple email accounts or online user
accounts from which to transmit emails.
No Unlawful Retransmission of Emails - Senders are prohibited from
relaying or retransmitting emails from a computer or computer network that was accessed
without authorization.

Any member that is a sender of an email that is in violation
of the above rules and/or any law or regulation is required to indemnify and hold
MgrCentral Pty Ltd and the relevant Advertiser harmless due to the sender's act
or omission in sending the email.
Note that adding any email address from any of our domains to an autoresponder,
newsletter or mailing list without our specific permission also constitutes spam,
and will result in your account being terminated, as our assumption must be that
if you are doing it to us you are doing it to others without their permission as
well.
In addition to termination of
their account, any member who sends spam emails, and such action results in the
termination of any MgrCentral Pty Ltd domain hosting account, will be the recipient
of legal action to recover monetary and incidental losses as a result of their action.
PROHIBITED ACTIVITIES
The following activities are prohibited in connection with your
account except where specific written permission has been obtained from Michael
Russell (CEO MgrCentral Pty Ltd). If you engage in any of the activities
detailed below your account will be deleted without notice.
- Obtaining more than one account. Any member found to be
signing up for multiple accounts in order to avoid payment of course fees will have
all accounts (including the original) deleted and they will be banned from the program
permanently by name, email address and IP number. Note that family members from the same
household ARE welcome as long as they create their own accounts and have their own
email address.
- Initiating a charge-back through your bank or credit card company
. Charge-backs severely damage the reputation and ability to transact business by
online companies. Any member that initiates a charge-back will have their account
deleted and will be banned from the program. Their details will also be advised
to relevant other organisations so they can avoid purchases by that member.
- Duplicating any part of the MPAM Courses or Lessons or websites or material on
a website, in an ebook, printed copy, on cd or dvd or via email, whether access
is granted for free or payment. All content and material is copyright to MgrCentral
Pty Ltd and all resources necessary will be expended to enforce this copyright,
regardless of where in the world the infringement takes place and regardless of
where the person or entity resides or is registered that is responsible for the
site.
- Uttering or writing false or misleading statements in your advertising
regarding MPAM. The MPAM system works very well as an income earning
educational course. It is NOT a get-rich-quick scheme, a pyramid or MLM scheme,
and it is not designed to provide instant success. Rather it is a very well planned,
proven set of educational courses which will over a sensible period and with work
and dedication from you enable you to succeed on-line.
- Uttering or making known statements that are detrimental to the program
or company that may contribute to a negative perception of the company or programs
owned by the company.
- Advertising in Traffic Exchanges. No page from the mgrcentral.com domain
or any page of any site owned by MgrCentral Pty Ltd that displays Adsense or
similar contextual advertising may be displayed in a Traffic Exchange or by any programmatic
or automatic means.
- Clicking on Contextual Ads. Members are PROHIBITED from clicking on any contextual ads
displayed on any site owned by MgrCentral Pty Ltd. This includes (but is not limited to) Ads by Google,
RevenuePilot, Searchfeeds, AdBrite or any other contextual ads. Any member found to be doing this
will not only have their account terminated but will be considered responsible for the loss of any
advertising revenue resulting from their actions, and will be pursued on a legal basis to the
full extent of our considerable financial resources to recover the lost revenue.
LIABILITIES
MgrCentral Pty Ltd makes no expressed or implied warranties with respect to this
or any sites, including the lessons, suitability of the courses for you and any
indication of possible income, except as is required by the laws of the State of
Western Australia. Any disputes will be settled under the jurisdiction of the courts
of Western Australia.
This includes, but is not limited to:

Incidental loss of member data.

Outside attacks (Hacks) against our servers.

Programming errors on our sites.
-
Inability to access site, due to downtime.
DISCLAIMERS
We reserve the right to e-mail all of our members with updates and notices about
our program at any time.
MgrCentral Pty Ltd reserves the right to modify these terms and conditions at any
time.
INFORMATION COLLECTED - PRIVACY STATEMENT
- All information collected upon signup is used for personal identification only.
This includes, but is not limited to, Name, Address, Phone Number, Email Address,
IP Number and Password.
- Upon deletion of your account your personal information is removed from the
database and destroyed.
- Your E-Mail Address and other personal information will never be shared
with nor sold to any third party.
- Information provided when registering on the Forums may be visible
to other members and as such all details with the exception of user-name and password
are optional.
- Other members in your team will be able to access your email address,
unless you specifically opt to hide your email address from them by checking the
box under member Details in your member Lounge. No member at any time is permitted
to send you commercial emails or emails relating anything other than MPAM issues
without your consent.
COMMUNICATION
All emails generated by the MPAM system will include the word [MPAM] or [Prosperity
with Integrity] in the subject line for easy identification, include details on
how to remove yourself from the system and are sent in full compliance with the
law.
- You agree that you are required to maintain an email address by which you can be
contacted which is not invalid, filters out our emails and is not bouncing. If an
email sent to the email address recorded in your member's Lounge bounces your account
will become 'Inactive'. Whilst your account is 'Inactive' you will receive no leads,
downline signups or information on changes to the system. Any account which is inactive
for 90 days or more may be deleted without notice.
- You agree to receive communications from your upline or downline requesting assistance
or providing advice on the Lessons and programs within the MPAM course, or regarding
MPAM itself, unless you have opted not to . These communications
may not contain advertisements, inducements or suggestions regarding programs outside
the MPAM system.
CHANGE OF SPONSOR
MgrCentral Pty Ltd reserves the right to change your sponsor in the program at any
time. The change of sponsor may occur:
a) If you request it and have a valid reason for requesting the change.
b) If your existing sponsor becomes unfinancial and is deativated.
c) If your existing sponsor requests it and has a valid reason for requesting the
change.
d) If your sponsor's account is deleted.
